PENNSYLVANIA METH CRIME LAWYER

Methamphetamine Charges in Pennsylvania – Speak to an Experienced Pittsburgh Criminal Lawyer

Know Your Rights. Fight Back.

A first time simple possession charge of a minimal amount of methamphetamine (crystal meth) could lead to up to one year in prison and have other repercussions like losing your driver’s license and having a criminal record.

A criminal record, whether it is a misdemeanor or a felony, can lead to many other difficulties in life like finding housing and employment, being ineligible for student loans, among a loss of many other personal rights, like gun ownership, that have a huge impact on your life and your future.

If you are facing a second or third conviction, or possession with intent to deliver charges, you face much more harsh penalties, including thousands of dollars in fines and a lengthy prison sentence that could ruin your life.

Although you face a serious, frightening and life changing situation, if you have been arrested and charged with simple possession of methamphetamine or possession with intent to deliver meth, this does not mean that you are guilty or will definitely have to go to jail.

An arrest is not a conviction.

Talking with an aggressive and experienced Pennsylvania meth crime attorney who knows how to fight for your rights is the first step to take. A strong attorney who thoroughly understands the court process could make all the difference as to whether you receive a drug conviction or not.

David J. Shrager is a compassionate Pennsylvania Criminal Lawyer who understands that good people make mistakes and that being charged with a drug crime is a scary ordeal.

Possession of Meth in PA – Charges, Penalties & Sentencing

There are sentencing guidelines that courts in Pennsylvania and the U.S. Federal Courts must follow for drug convictions, misdemeanors and felonies. These guidelines are very severe for narcotics. Read the full PA sentencing guidelines here. You can read the U.S. federal trafficking penalties for methamphetamine here.

The following penalties apply after a drug conviction for methamphetamine, according to Pennsylvania drug sentencing guidelines.

Simple Possession of Methamphetamine (less than two grams):

The punishment for a simple possession of meth conviction in Pennsylvania is one year in prison and a $5,000 fine for a first offense. You could also lose your driver’s license from PennDOT for six months.

A second or subsequent conviction could mean two or three years in prison and a larger fine.

The conviction also puts a mark on your criminal record, making it difficult to find jobs and housing, go to college, obtain a mortgage or other financing in the future.

Possession with Intent to Deliver Methamphetamine:

Possession with Intent to Deliver, or PWID of drugs, is also known as drug trafficking. You may face these charges if the police suspect you of selling, distributing or manufacturing a controlled substance.

If you are found with a high quantity of methamphetamine, you may be charged with PWID.

Penalties upon conviction of PWID Methamphetamine include:

  • Two to ten grams: Felony, up to two years in prison, up to $5,000 fine for a first offense. Subsequent offenses face up to three years in prison and a $10,000 fine.
  • Ten to 100 grams: Felony, up to three years in prison and a $15,000 fine for a first offense. Subsequent offenses face up to five years in prison and a $30,000 fine.
  • Over 100 grams: Felony, five years in prison and a $25,000 fine for a first offense. Subsequent offenses face up to seven years in prison and a $50,000 fine.

If you are charged with PWID of Methamphetamine, you may be charged in both Pennsylvania and United States Federal courts. If this is the case, you will need an experienced federal attorney to help defend your rights.

WHAT A PA METH CRIME ATTORNEY CAN DO FOR YOU

A skilled Pennsylvania drug attorney is going to do everything possible to fight for your rights. Your attorney will closely examine all the alleged facts in the case, interview witnesses, gather police reports and investigate all evidence in order to prove your innocence or have your sentencing reduced.

For you to have been arrested, probable cause had to have existed for the arresting officers. If your arrest was due to an illegal search by the police, your charges could be dismissed. Our attorneys will work to find any holes in the police reports and evidence or missteps they may have taken during their procedures. If they did not follow proper procedures, your case could be dismissed completely.

Oftentimes people who are charged with drug possession are struggling with addiction. An aggressive attorney may be able to persuade the District Attorney to allow you to enter a drug treatment program instead of serving time in prison.

Options exist like The Allegheny County Drug Court Program, which is a rehabilitative program that can shorten prison sentencing. The Probation without Verdict Program (PWV) is another option which could allow your charges to be dropped completely and your criminal record expunged.

It is important to have an aggressive and experienced attorney on your side to fight for your acceptance into these programs.
