WHAT IS AN ARREST WARRANT?
There are several types of warrants that can be issued in correlation with a crime. An arrest warrant is necessary in those criminal cases where a person is suspected of a crime and the police now believe they have obtained enough evidence to prove that the suspect is indeed the culprit.
Obtaining sufficient evidence to get approval for an arrest warrant is called probable cause. Without probable cause, issuance of a warrant will be denied.
An arrest warrant can only be issued by a judge. The police cannot arrest and detain a person without first proving to a judge that they have sufficient reason to suspect a person of committing a crime.
The sole purpose of an arrest warrant is to authorize the police to take you into custody. An arrest warrant will remain valid until the police are able to locate you and complete the arrest.
An arrest warrant can be executed anywhere in Pennsylvania and still be valid as long as it contains the proper information and is executed by a police officer and authorized by a magisterial district judge.
THE INFORMATION CONTAINED IN AN ARREST WARRANT
If the arrest warrant does not contain specific and proper information, the arrest will not be legal. A knowledgeable defense attorney will know exactly what to look for, and whether or not your arrest warrant was valid.
A proper arrest warrant will contain the following information:
- The Defendant’s exact name and/or a detailed description of the individual the police are arresting. The description must be adequate. An arrest warrant may be determined to be invalid for vagueness.

- It must be signed and authorized by a judge.
- It must state the date and time of the issuance of the warrant, along with the city and/or county from which it has been issued.
AFTER THE ISSUANCE OF AN ARREST WARRANT
Once the arrest warrant is complete and authorized by a judge, the police will likely expend effort to locate you and take you into custody for the alleged crime.
They can arrest you wherever they happen to locate you – home, work, school, a social event. There is not a restriction on where the police may arrest you.
In Pennsylvania, arrest warrants are issued most frequently for the following crimes:
- Criminal misdemeanors
- Criminal Felonies
- Unpaid Child Support
Again, arrest warrants are generally issued for persons who are already suspects of a crime. The police have already obtained evidence against you and are looking to take you into custody to face charges. The arrest warrant will not expire and you must face a judge in order to get the warrant cleared.
