SENTENCING AND PENALTIES FOR A CHILD PORNOGRAPHY CONVICTION
Mandatory minimum sentences for federal child pornography include five years of prison time for any of the following offenses:
- Receipt of Child Pornography
- Distribution of Child Pornography
- Possession of Child Pornography with Intent to Distribute or Sell
- Transportation of Child Pornography
- Production of Child Pornography
Photographing child pornography or causing a child to participate in the making of pornography is a felony with a penalty of up to ten years in prison and a maximum $25,000 fine.
If you possess or distribute child pornography, you could be convicted of a felony and sentenced to up to seven years in prison and up to $15,000 in fines.
Circulating or spreading sexually explicit material to a minor is also a felony and punishable with prison time and hefty fines. Other lewd acts toward children may be considered misdemeanors and if convicted could sentence you to up to five years in prison and $10,000 in fines.
Recently, Pennsylvania passed House Bill 321, which toughens the penalties for possessing child pornography. The guidelines are based upon the child’s age, the number of images in possession, and whether the images involve indecent conduct with the child.
