Charges for Child Pornography, also known in Pennsylvania as Sexual Abuse of Children, are very serious charges that come with lengthy prison sentences and heavy fines if convicted.

Speaking with an experienced Pittsburgh Child Pornography Attorney about your charges is imperative.

Being charged with child pornography does not mean that you are guilty or that you will be convicted.

Federal sentencing for convicted child pornography offenders has drastically increased over the past fifteen years. Not to mention, convicted child sex offenders in Pennsylvania are required to register as sex offenders, under each jurisdiction they work, live or go to school. The national register is visible to anyone with an Internet connection.

In addition, The Adam Walsh Act, now under SORNA, requires some sex offenders to register their whereabouts every three months for the rest of their lives.

Being registered as a sex offender could remain on the Internet, available for all to see, throughout the remainder of your life, ruining many things in your future, like employment opportunities, where you are legally allowed to live and, of course, your reputation.

Failure to register as a sex offender in Pennsylvania is a felony and could lead to a prison sentence and hefty fines.

SENTENCING AND PENALTIES FOR A CHILD PORNOGRAPHY CONVICTION

Mandatory minimum sentences for federal child pornography include five years of prison time for any of the following offenses:

  • Receipt of Child Pornography
  • Distribution of Child Pornography
  • Possession of Child Pornography with Intent to Distribute or Sell
  • Transportation of Child Pornography
  • Production of Child Pornography

Photographing child pornography or causing a child to participate in the making of pornography is a felony with a penalty of up to ten years in prison and a maximum $25,000 fine.

If you possess or distribute child pornography, you could be convicted of a felony and sentenced to up to seven years in prison and up to $15,000 in fines.

Circulating or spreading sexually explicit material to a minor is also a felony and punishable with prison time and hefty fines. Other lewd acts toward children may be considered misdemeanors and if convicted could sentence you to up to five years in prison and $10,000 in fines.

Recently, Pennsylvania passed House Bill 321, which toughens the penalties for possessing child pornography. The guidelines are based upon the child’s age, the number of images in possession, and whether the images involve indecent conduct with the child. Read PA House Bill 321 on Sentencing for Offenses Involving Sexual Abuse of Children here.

In addition to these penalties, you may be required to register as a sex offender for the rest of your life under the Sexual Offender Registration and Notification Act (SORNA) / Megan’s Law in Pennsylvania.

The Pennsylvania Wire Tap Act

It is becoming more common for Cyber Crime Officers to go undercover, pretending they are minors or child pornography peddlers in order to catch suspects in Internet sex crimes and/or child pornography distribution and sales.

The PA Wire Tap Act can be used to entrap people seeking to travel to have sex with minors or to lure minors with the intent of having sexual relations with them. If you have been charged with a crime it is imperative that you have an experienced Child Pornography Attorney at your defense. An aggressive and experienced Child Pornography Attorney will look for any violations in the officers’ methods to try to suppress evidence and have your case dismissed.

Federal Charges

Possession and distribution of child pornography is also prosecuted as a federal crime. The Prosecutorial Remedies and Other Tools to End the Exploitation of Children Today (PROTECT) Act of 2003 illegalizes the production, distribution, or possession of any type of child pornography. It is also a federal crime to use a computer to ship, transport, receive, distribute, or reproduce for distribution child pornography or to solicit pornographic images of children. You can read more about federal charges of child pornography on The United States Department of Justice website.

Being charged with a federal crime is a much more complex affair and will take an experienced attorney to tackle all the paperwork and prepare a strategic defense.
