Drug Distribution Attorneys in Pennsylvania

A drug distribution conviction on your record will have severe repercussions on your future, including a prison sentence and costly fines, even for a first offense.

Drug distribution can involve simply sharing a joint with a friend to being accused of participation in a drug trafficking ring.

PA law defines “distribute” as “to deliver other than by administering or dispensing a controlled substance, other drug, device or cosmetic.”

You can be charged for drug distribution even if you did not sell any drugs. If you delivered a package for a friend that contained illegal drugs or illegally obtained prescription medication, that is considered drug distribution – even if you did not accept money for the delivery.

The penalties for drug distribution are much more severe than the penalties for simple possession and fall under the Possession With Intent to Deliver (PWID) sentencing guidelines.

At Shrager Defense Attorneys, we understand that sometimes good people make mistakes and that many times innocent people are accused under false pretenses and misunderstandings. In addition, often times illegal search and seizures take place by the arresting officers if they do not have probable cause.

Our experienced Pittsburgh Drug Lawyers will examine and investigate your case closely to find any holes in the prosecution’s theory of your alleged drug crime. We will fight aggressively for your rights.

PENALTIES FOR DRUG DISTRIBUTION IN PA

Pennsylvania currently does not have minimum sentencing requirements for a drug distribution PWID conviction – the U.S. Federal Court system does. This means spending at least one year in prison, depending on the quantity of the drug and type of drug.

Under current Pennsylvania law the manufacturing, cultivation, or distribution of controlled substances (drugs) all fall under the offense of Possession With Intent to Deliver (PWID).  Each of these acts is considered to demonstrate, at least, an intent to sell or distribute drugs.

The penalties for each of these acts are the same, and are not directly related to weight or volume with the exception of marijuana where the possession of 1000 lbs or more carries enhanced penalties.

Talking with an experienced drug crime attorney like David J. Shrager is the best way to know what penalties you face, given your circumstances and prior convictions. It is also advisable to consult with an experienced federal crime attorney who has had success in defending within the U.S Court System.
