WHO QUALIFIES FOR THE ALLEGHENY COUNTY DRUG DIVERSION PROGRAM?
This program is voluntary and is meant to help people get drug free and change the course of their life. It is a lot of work and therefore, the District Attorney’s office determines entrance based on strict qualifications.
In order to enter the Drug Diversion program you must meet the following requirements:
- Be a resident of Allegheny County
- Have an active pending court case or probation violation in Allegheny County
- Have a documented history of substance abuse
- Be willing to plead guilty to all charges
- Agree to an evaluation by a court drug specialist and willingly accept treatment
- You cannot be charged with any violent offense or have any previous convictions for a violent conviction in the last ten years.
- In many cases, you must be recommended to the program by a defense attorney.
HOW THE DRUG DIVERSION PROGRAM WORKS
Should you qualify for the program, an offer will be made at pretrial by the prosecutor.
Next, you will be interviewed by a drug court specialist who will conduct a drug and alcohol evaluation using the Pennsylvania Client Placement Criteria. The drug specialist will determine their recommendations based upon your interview and evaluation.
You will either be placed in a treatment facility, or you may receive outpatient care.
In order to participate in the program, however, you must be willing to plead guilty to all of your charges and complete all of the treatment requirements you are given.
General requirements of the Allegheny County Drug Diversion Program typically include:
- Completion of all the requirements set forth by the drug court specialist;
- Attending Alcoholics Anonymous and/or Narcotics Anonymous;
- Staying clean and sober throughout treatment and probation;
- Compliance with your treatment facility and/or house arrest, and;
- Getting a job and/or attending school.
If you are recommended to a residential treatment program, you will begin the day after your plea. Once you have completed the treatment program, you will then be given an electronic monitoring device and complete the probation period of your sentence.
If it is determined that you can complete your requirements as an outpatient, you will wear an electronic monitoring device on the day of your plea and continue to do so until you have completed all requirements.
If you comply with all requirements it is likely that you will serve a six month probation. During this time you will have to check in with a probation officer, submit to drug and alcohol testing and continue attending drug and/or alcohol treatment meetings such as Alcoholics Anonymous or Narcotics Anonymous.
Successful completion of treatment and probation requirements will lead to a discharge and release from your sentence. However, if you fail to comply with all of the terms and requirements of the program, you risk being re-sentenced – with the possibility of serving 3 to 30 days in jail in addition to other possible penalties.
