SENTENCING & PENALTIES FOR MANUFACTURING DRUGS IN PA

Both Pennsylvania and the U.S. Federal Government have minimum sentencing requirements for a drug manufacturing conviction. You may also face Federal Charges for manufacturing drugs, in addition to being tried by Pennsylvania.

MARIJUANA:

Cultivation/Growing Marijuana – Minimum Sentencing*

  • First offense, 10-21 plants: Felony, one year minimum in prison and a maximum $5,000 fine.
  • First offense, 22-51 plants: Felony, three years minimum in prison and a maximum $15,000 fine.

Marijuana Hash and Concentrates – Minimum Sentencing*

  • Manufacturing: Felony, five years in prison and a $15,000 fine.

COCAINE:

Manufacturing Cocaine – Minimum Sentencing*

First Offense:

  • Two to Ten grams: Felony, minimum of one year in prison.
  • 11 to 99 grams: Felony, minimum of three years of prison.
  • 100 grams or more: Felony, minimum of four years of prison.

Second Offense:

  • Two to Ten grams: Felony, minimum of three years in prison.
  • 11 to 99 grams: Felony, minimum of five years of prison.
  • 100 grams or more: Felony, minimum of seven years of prison.

HEROIN:

Manufacturing Heroin – Minimum Sentencing*

  • One to five grams: Felony, mandatory two years in prison for a first offense.
  • Six to 50 grams: Felony, minimum three years in prison for a first offense.
  • Over 50 grams: Felony, minimum five years in prison for a first offense.

PRESCRIPTION MEDICATION:

Prescription Medication Manufacturing – Minimum Sentencing*

The penalties for illegally manufacturing prescription medication can be just as harsh or more so than manufacturing illegal drugs.

Each type of drug falls under a “Schedule” under Pennsylvania’s Controlled Substances, Drugs, Device, and Cosmetic Act.

These are the minimum penalties for the different types of prescription meds by schedule:

  • Schedule V drugs: Misdemeanor, up to a year in jail and a fine of up to $5,000.
  • Schedule IV drugs: Up to three years in prison and a $10,000 fine.
  • Schedule I, II, or III drugs: Up to five years in prison and a $15,000 fine

*Penalties can be greater if this is your second or subsequent offense, or if you are found with drugs in a school zone, selling drugs to a minor or carrying an illegal weapon. For manufacturing heroin, fines can run up to $250,000 and up to 15 years in prison. For manufacturing drugs like PCP or cocaine, fines can be as high as $100,000 and up to 10 years in prison.

FORFEITURE OF PROPERTY
