DUI WITH A CDL – PENALTIES AND SENTENCING GUIDELINES
When considering a DUI arrest, most people assume that the standard level for a person’s Blood Alcohol Content (BAC) level is .08 percent. While this is true for non-commercial drivers, CDL holders are held to a much higher standard in the state of Pennsylvania.
In Pennsylvania, a drunk driver is considered impaired with a BAC level of only .02 percent.
All it takes is the equivalent of a single beer to come between you and your livelihood. A CDL holder with a BAC level of .04 percent can place you in the State’s High Impairment Tier, meaning you face up to six months in jail and a license suspension of one year, plus a maximum fine of $5,000. If you drive a school bus, a BAC level of only .02 percent will also place you in the State’s High Impairment Tier.
Keep in mind, CDL holders are not restricted to violations that occur while driving a commercial vehicle or while on duty. Even if you are off duty and in your own personal vehicle you face these harsher penalties, because you are a CDL holder
If convicted of a DUI with a CDL as a first offense you will automatically receive a minimum 12 month license suspension. In addition, you could face fines from $500 – $5,000 and possible jail time anywhere from two days to six months.
A second offense will require the same minimum 12 month license suspension, but increased fines of $750 – $5,000 and jail time anywhere from one to six months.
Should you fall into the State’s Highest Impairment Tier with a higher BAC level, you will receive a minimum license suspension of 18 months with fines up to $10,000 and up to five years in jail.
A CDL holder with two or more serious traffic violations, including, but not limited to: excessive speeding, reckless driving, failure to yield, texting while driving and following too closely, could also lose their CDL for life.
