HOW CAN YOU LOSE YOUR LICENSE WITH A DUI IN PA?
Every driver that obtains a driver’s license in Pennsylvania has a driving record that is kept by The Pennsylvania Department of Transportation, or PennDOT.
PennDOT uses a point system to keep the roads safe. If you receive traffic violations, for example, you may get a point or two on your driving record. So, if you are convicted of a DUI, PennDOT will be notified and, depending on the punishment you have received, may suspend or revoke your driver’s license.
You can also lose your license in Pennsylvania for refusing to submit to a breathalyzer or blood test to determine the amount of alcohol you consumed.
LICENSE PENALTIES IN PENNSYLVANIA FOR A DUI
If you have refused a breathalyzer or blood test after being arrested for DUI, you will lose your license for a period of 12 months for a first offense refusal. If you have received two or more DUIs and you refuse to submit to testing, you will lose your license for a period of 18 months.
Pennsylvania uses a three tier system for determining DUI penalties. The system is based on the defendant’s Blood Alcohol Content or BAC, and how many DUIs they have previously had.
The following license penalties apply for a DUI charge in Pennsylvania:
- If the driver has a BAC of .08% – .099% and it is a first offense DUI, there will be no loss of license, but an ignition interlock system is required on the driver’s vehicle for at least one year. Please read about the 2017 changes to the law for first time DUI offenders.
For a second DUI Offense or subsequent offense, there will be a 12-month license suspension.
- If the driver has a BAC of .10% – .15% and it is a first offense, there be a 12-month license suspension for a first or second offense.
For a third and subsequent offense, there will be an 18-month license suspension.
- If the driver has a BAC of .16% or higher and it is a first offense, there will be a 12-month loss of license.
For a second or subsequent offense, there will be an 18-month loss of license.
If the driver has a Commercial Driver’s License (CDL) and they are charged with DUI, they will lose their CDL for a period of one year. A second DUI conviction for a CDL holder will result in being barred for life.
License suspension does not officially begin until PennDOT receives notification of your conviction and punishment.

HOW DO I GET MY LICENSE REINSTATED AFTER SUSPENSION OR REVOCATION?
Many people falsely believe that once the period of suspension or revocation has ended, their license is automatically reinstated. This is not the case. In fact, driving without a license after a DUI conviction can lead you to more trouble.
Once the license suspension or revocation period ends, it is important that you apply for reinstatement. If your license was suspended for more than one year, or was revoked, you must take the driver’s exams again as well.
