Sexual Offender Registration and Notification Act (SORNA) / Megan’s Law

If you have been convicted of a sex crime you are required to register as a sex offender under Megan’s Law or what is also known as the Sexual Offender Registration and Notification Act (SORNA). Depending on the original criminal conviction, you may be required to register every 90 days, six months, or annually.

Sex Offender Registration Requirements in Pennsylvania

Depending on the nature of the sex crime conviction, you could be required to register as a sex offender for the rest of your life.

If you have been charged with failure to register as a sex offender in Pennsylvania, it could have been for suspicion of violating any of the following:

  • Failure to provide accurate information when registering
  • Failure to register with the Pennsylvania State Police as required
  • Failure to verify your address
  • Failure to be photographed as required

Regardless of whether or not you received a notification from the police, if you were required to register and failed to do so, you can face felony charges. Not receiving a notice is not a defense against your charges.

If you no longer live or work or go to school in the jurisdiction you are required to register under, you still have to comply.

Megan’s Law, the Adam Walsh Act and SORNA (Sexual Offender Registration And Notification Act)

Beginning on December 20, 2012 there were changes made to the registration law, known as Megan’s Law. These changes lengthen the amount of time sex offenders must continue to register in their jurisdiction(s). These changes come under what is known as the Sexual Offender Registration and Notification Act or SORNA. 

SORNA falls under Title 1 of the federal Adam Walsh Act, which was enacted in 2006 and created the sex offender registry. Under SORNA, convicted sex offenders are organized into three tiers based on the crime committed, with the third tier being the most serious.

Under SORNA, Tier III offenders are required to update their whereabouts every three months for the rest of their lives. Tier II offenders are required to register every six months for 25 years and Tier I offenders are required to register every year for 15 years. Pennsylvania meets all of the SORNA requirements in this subsection.

SORNA also requires each jurisdiction to maintain a public sex offender registry website and publish certain registration information on that website.

Failure to register under SORNA is a felony and could send you to prison, possibly for life depending on the crime of which you were originally convicted and how many times you have been in violation of registering.

SORNA has generally made it more difficult for sex offenders to provide inaccurate information and enforces them to keep their registration current in each jurisdiction they live or work. It also requires sex offenders to make periodic in-person appearances to verify and update registration information.

Penalty For Not Complying With SORNA or Megan’s Law

The severity of the original conviction determines whether a person who fails to register will face a first, second or third degree felony. The degree of the felony determines the length that a person could be sentenced to prison if found guilty of the violation.

The punishment for not registering can have detrimental consequences for you and your family. Failure to register could mean life imprisonment and a $25,000 fine.

SORNA requires that Pennsylvania include a maximum term of imprisonment that is greater than one year for the failure of a sex offender to comply with their registration requirements.

It is very difficult to try to “hide from the system” under SORNA. When a sex offender fails to appear for registration, SORNA requires that the jurisdiction where the offender intends to reside, work or go to school, inform the originating jurisdiction that the offender failed to appear for registration.
