HEALTH CARE FRAUD CHARGES IN PENNSYLVANIA

Facing allegations or charges for health care fraud, Medicare fraud or Medicaid fraud is a stressful and frightening situation. The penalties in Pennsylvania for a conviction of health care fraud could lock you in prison for years, not to mention give you a criminal record for life.

Depending on the type of health care fraud, you may be charged both within the Commonwealth of Pennsylvania and in U.S. Federal courts and could even be charged twice, or face multiple charges. Investigators are thorough and it can take months or years to indict suspects.

Whether you are charged with lying on a Medicaid application or are a physician charged with defrauding a patient, you face severe penalties, if convicted.

Many times physicians and healthcare providers find themselves under an investigation for possible healthcare fraud. There are many triggers that can prompt the Feds to begin an investigation, and many of these signals may be false – but if you are under investigation, you should speak to an experienced attorney right away.

Your Rights Are Worth the Fight

If you have been charged, arrested or suspect that you may be charged for health care fraud soon, it is in your best interest to call an experienced Pennsylvania Fraud Attorney right away.

The Federal Bureau of Investigation (FBI), the Office of Inspector General (OIG), and the Drug Enforcement Administration (DEA) actively investigate Pennsylvania healthcare providers in order to prosecute them in suspected medical fraud, such as corrupt billing practices (double billing, etc.), administering unnecessary tests, and illegal kickbacks.

While under investigation, it may seem like the problem will resolve itself, but once a conviction occurs, it can ruin your business or send you to prison.

At Shrager Defense Attorneys, we work closely with you to fight for your rights and build a strong defense, taking every legal action available to have the investigation stopped, and any charges withdrawn and, ultimately, make attempts for the case to be dismissed.

Pittsburgh Criminal Lawyer David J. Shrager does his absolute best to help people retain their rights and freedom so they can go on with their lives without worry for their future – so they can keep their license, career, clean record, and provide for their families.

WHAT IS HEALTH CARE FRAUD?

Health care fraud covers a broad array of offenses related to defrauding an insurer, agency, or person.

It can come in the form of:

  • Health insurance fraud: when a company, physician, healthcare provider or an individual defrauds an insurer or government health care program, such as Medicare or Medicaid or an equivalent State program.
  • Legal Drug fraud: when a physician prescribes medication for a patient under false pretenses, in order to obtain kickbacks from the manufacturer.

Mainly, health care fraud involves filing dishonest health care claims for profit. The charges will be very different depending on if you are an individual who made false claims or if you are a physician or medical provider.

Healthcare fraud cases may be prosecuted under U.S. Code 18 U.S.C. §1347.

Examples of Health Care Fraud committed by health care providers can include the following:

  • Submitting false claims;
  • Billing for “ghost” patients;
  • Billing for services never provided;
  • Billing for a non-covered service as a covered service;
  • Modifying medical records and documents;
  • Intentionally misreporting diagnoses or procedures to maximize payment;
  • Up-coding;
  • Employing an unlicensed staff member;
  • Prescribing or scheduling unnecessary tests, exams or procedures;
  • Receiving kickbacks.

Examples of Health Care Fraud committed by individuals can include the following:

  • Making false statements on Medicare or Medicaid applications;
  • Obtaining subsidized prescription medication that are not needed and then selling them for profit;
  • Loaning an insurance card or using someone else’s card in order to obtain medical services.

PENALTIES FOR COMMITTING HEALTH CARE FRAUD IN PENNSYLVANIA

In Pennsylvania the amount of money allegedly stolen and the other potential and alleged charges (such as theft), will determine the length of the prison sentence and amount of the fine.

If an individual is found guilty of Medicare fraud, a federal crime, you can receive up to ten years in prison for each count. Penalties also include probational release, fines, an asset forfeiture.

In other healthcare cases, the penalty is dependent upon the amount defrauded and sentencing is based on Federal Sentencing Guidelines.

According to the U.S. Code of Health Care Fraud18 U.S.C. §1347:

  • If the violation results in serious bodily injury (as defined in section 1365 of this title), such person shall be fined under this title or imprisoned not more than 20 years, or both; and if the violation results in death, such person shall be fined under this title, or imprisoned for any term of years or for life, or both.

In addition to financial burden and a lengthy prison sentence, those found guilty of health care fraud may carry the label of convicted felon for life.

With one’s quality of life and reputation at stake, it is prudent and imperative to choose a highly qualified and experience Pittsburgh fraud attorney who can represent your interests and be aggressive in defending your rights.
