WHAT IS HEALTH CARE FRAUD?

Health care fraud covers a broad array of offenses related to defrauding an insurer, agency, or person.

It can come in the form of:

  • Health insurance fraud: when a company, physician, healthcare provider or an individual defrauds an insurer or government health care program, such as Medicare or Medicaid or an equivalent State program.

PENALTIES FOR COMMITTING HEALTH CARE FRAUD IN PENNSYLVANIA

In Pennsylvania the amount of money allegedly stolen and the other potential and alleged charges (such as theft), will determine the length of the prison sentence and amount of the fine.

If an individual is found guilty of Medicare fraud, a federal crime, you can receive up to ten years in prison for each count. Penalties also include probational release, fines, an asset forfeiture.

In other healthcare cases, the penalty is dependent upon the amount defrauded and sentencing is based on Federal Sentencing Guidelines.

According to the U.S. Code of Health Care Fraud – 18 U.S.C. §1347:

  • If the violation results in serious bodily injury (as defined in section 1365 of this title), such person shall be fined under this title or imprisoned not more than 20 years, or both; and if the violation results in death, such person shall be fined under this title, or imprisoned for any term of years or for life, or both.
