Possession of Heroin in PA – Charges, Penalties & Sentencing
Simple Possession of Heroin (less than one gram):
- Misdemeanor, one year in prison, first offense.
- Misdemeanor, three years in prison, second or subsequent offense.
Buying Heroin:
- Misdemeanor, three years in prison for a first offense.
Possession with Intent to Deliver:
- Felony; maximum imprisonment of 15 years, or a fine not exceeding two hundred fifty thousand dollars ($250,000), or both. This fine can be increased to exhaust the profits obtained from the illegal activity.
