Schedule II narcotic prescription drugs such as Hydrocodone (Vicodin) and Oxycodone (OxyContin, Percocet) – Felony; maximum imprisonment of 15 years, or a fine not exceeding two hundred fifty thousand dollars ($250,000), or both. This fine can be increased to exhaust the profits obtained from the illegal activity.

Schedule IV prescription drugs such as Alprazolam (Xanax), Clonazepam (Klonopin), Diazepam (Valium), Lorazepam (Ativan), and Temazepam (Restoril) – Felony; imprisonment not exceeding three years, or a fine not exceeding ten thousand dollars ($10,000), or both.

Schedule V prescription drugs such as Robitussin AC, Phenergan with Codeine, Pregabalin (Lyrica) and Pyrovalerone (Centroton, Thymergix) – Misdemeanor; imprisonment not exceeding one year, or a fine not exceeding five thousand dollars ($5,000), or both.
