AGGRAVATED INDECENT ASSAULT AND INDECENT ASSAULT DEFINED

Aggravated Indecent Assault occurs when a person engages in penetration, however slight, of the genitals or anus of a complainant with a part of the person’s body for any purpose other than good faith medical, hygienic or law enforcement procedures commits aggravated indecent assault if:

  • the person does so without the complainant’s consent;
  • the person does so by forcible compulsion or the threat of forcible compulsion;
  • the complainant is unconscious or the person knows that the complainant is unaware that the penetration is occurring;
  • the person has given drugs, intoxicants or used other means, without the knowledge of the complainant, for the purpose of preventing resistance;
  • the complainant suffers from a mental disability which renders him or her incapable of consent;
  • the complainant is less than 13 years of age; or
  • the complainant is less than 16 years of age and the person is four or more years older than the complainant and the complainant and the person are not married to each other.

Indecent Assault is a slightly less serious crime than Aggravated Indecent Assault. An Indecent Assault occurs when a person has indecent contact with the complainant, causes the complainant to have indecent contact with the person or intentionally causes the complainant to come into contact with seminal fluid, urine or feces for the purpose of arousing sexual desire in the person or the complainant and:

  • the person does so without the complainant’s consent;
  • the person does so by forcible compulsion or the threat of forcible compulsion;
  • the complainant is unconscious or the person knows that the complainant is unaware that the indecent contact is occurring;
  • the person has given drugs, intoxicants or other means, without the knowledge of the complainant, for the purpose of preventing resistance;
  • the complainant suffers from a mental disability which renders the complainant incapable of consent;
  • the complainant is less than 13 years of age; or
  • the complainant is less than 16 years of age and the person is four or more years older than the complainant and the complainant and the person are not married to each other.

AGGRAVATED INDECENT ASSAULT PENALTIES IN PENNSYLVANIA

In the state of Pennsylvania, an Aggravated Indecent Assault is a Felony of the Second Degree. The penalty for conviction is:

  • Sentencing of up to 10 years in prison.

If the assault took place with a child younger than 13 years of age, the charge increases to a Felony of the First Degree. The penalty for a conviction is:

  • Sentencing up to 20 years in prison.

INDECENT ASSAULT PENALTIES IN PENNSYLVANIA

In the State of Pennsylvania, an Indecent Assault has varying degrees of punishment depending on the circumstances of the case.

If the case is one of indecent assault committed without consent or with a complainant less than 16, the charge will be a Misdemeanor in the Second Degree. A Misdemeanor in the Second Degree is punishable by:

  • A maximum sentence of up to two years in prison and a $5,000 fine.

If the circumstances involved any of the other circumstances, the charge increases to a Misdemeanor of the First Degree. A Misdemeanor of the First Degree is punishable by:

  • A maximum sentence of up to five years in prison and a $10,000 fine.

However, if the act took place with a child younger than 13 and there is a history of prior indecent assault, or the person touched the complainant’s intimate parts with their hands or with their own intimate parts, the charge increases to a Felony of the Third Degree. A Third Degree Felony is punishable by:

  • A maximum sentence of up to seven years in prison and a $15,000 fine.

In addition, these sex crimes will also require you to register as a sex offender. Being registered as a sex offender requires that you list certain information about yourself and your whereabouts, making it very difficult to find employment and a place to live.

Under the Sexual Offender Registration and Notification Act (SORNA) sex offenders are required to register their whereabouts in each jurisdiction they live, work and go to school, in some cases for the rest of their lives.

Failure to register as a sex offender is a felony and can lead to prison time and thousands of dollars in fines.
