WHAT IS INVOLUNTARY DEVIATE SEXUAL INTERCOURSE?
While IDSI is similar to rape, it includes a broader range of sexual acts. A person is guilty of IDSI when they engage in deviate sexual intercourse with a complainant by forcible compulsion. Deviate sexual intercourse includes penetration with a foreign object, oral sex, anal sex and sexual acts with an animal.
The offense is IDSI if the offender commits a deviate sexual act on another and one or more of the following:
- Prevents the other person from resisting, by force or threat of force;
- Has IDSI with a person who is unconscious or unaware;
- Gives drugs or alcohol to the other person to have IDSI without resistance;
- Has IDSI with a person with a mental disability that makes them incapable of giving consent;
- Has IDSI with someone less than 16 years of age, or more than four years younger than offender, if they are not married.

PUNISHMENT FOR INVOLUNTARY DEVIATE SEXUAL INTERCOURSE
If you are convicted of IDSI, you will face very harsh penalties and judges are not likely to go easy on your sentencing. IDSI is a Felony of the First Degree and punishable includes:
- Sentencing of up to 20 years in prison and up to $25,000 in fines.
- In addition, you will be required to register as a sex offender for the rest of your life.
Being registered as a sex offender requires that you list certain information about yourself and your whereabouts, making it very difficult to find employment and a place to live.
Under the Sexual Offender Registration and Notification Act (SORNA) sex offenders are required to register their whereabouts in each jurisdiction they live, work and go to school, in some cases for the rest of their lives.
Failure to register as a sex offender is a felony and can lead to prison time and thousands of dollars in fines.
ADDITIONAL PUNISHMENT FOR AN IDSI CONVICTION

INVOLUNTARY DEVIATE SEXUAL INTERCOURSE WITH A CHILD
If the offender commits a deviate sexual act on a child younger than 13, even with consent, the penalties will be much more severe. The charge is a Felony of the First Degree and punishable by:
- A maximum sentence of 40 years in prison.
Should the child suffer serious bodily injury as a result of the deviate sexual act, the charge is a Felony of the First Degree and punishable by:
- A maximum sentence of life in prison.
It is important to note that being unaware of the child’s actual age is not a proper defense to this crime.
