Possession of Meth in PA – Charges, Penalties & Sentencing
There are sentencing guidelines that courts in Pennsylvania and the U.S. Federal Courts must follow for drug convictions, misdemeanors and felonies. These guidelines are very severe for narcotics. The following penalties apply after a drug conviction for methamphetamine, according to Pennsylvania drug sentencing guidelines.
Simple Possession of Methamphetamine (less than two grams):
The punishment for a simple possession of meth conviction in Pennsylvania is one year in prison and a $5,000 fine for a first offense. You could also lose your driver’s license from PennDOT for six months.
A second or subsequent conviction could mean two or three years in prison and a larger fine.
The conviction also puts a mark on your criminal record, making it difficult to find jobs and housing, go to college, obtain a mortgage or other financing in the future.
Possession with Intent to Deliver Methamphetamine:
Possession with Intent to Deliver, or PWID of drugs, is also known as drug trafficking. You may face these charges if the police suspect you of selling, distributing or manufacturing a controlled substance.
If you are found with a high quantity of methamphetamine, you may be charged with PWID.
Penalties upon conviction of PWID Methamphetamine include:
- Felony; imprisonment not exceeding ten years, or a fine not exceeding one hundred thousand dollars ($100,000), or both. This fine can be increased to exhaust the profits obtained from the illegal activity.
