If you are over 21 many factors come into play. One of the most important being your Blood Alcohol Content (BAC) level, which will determine the severity of the penalties and fines you face.

  • Highest Rate of Alcohol: Refusal to take a chemical test, BAC of .16% or higher, or drug use.

Depending on whether this is your first DUI offense, second DUI or whether you have had multiple offenses, your charges and penalties will vary.

First Time DUI Penalties

What Shrager Defense Attorneys Can Do For You

First of all, we empathize with your situation and talk to you plainly about the consequences you may face, not in complicated “legal-eze”.  Our staff will never talk down to you or make you feel worse about your situation. We are here to help you understand the charges brought against you and the legal proceedings you face, so that we can better defend your rights.

Secondly, we closely examine the criminal complaint brought against you and confusing paperwork you will receive. We examine the police reports and videotape to see if the police treated you fairly and all evidence was collected legally. If evidence is suspected of having been obtained illegally, we will motion for the evidence to be suppressed. If a judge grants suppression, your case may be dismissed.

Thirdly, we prepare you for the preliminary hearing, which will determine whether or not your case will be moved forward to prosecution for a DUI. During your hearing, the officer who made your arrest will be present. This can be the toughest part of the entire process and having an experienced lawyer who knows the ins-and-outs of these proceedings is essential to helping your case.

Having a good DUI lawyer present during your hearing can make all the difference in whether or not your charges will be reduced or even dropped completely.

We will weigh all of your options, including a trial, negotiated pleas, and Accelerated Rehabilitative Disposition (ARD), to get your charges and fines reduced or dropped.

Shrager Defense Attorneys are experienced DUI lawyers in Pittsburgh, PA who, for years, have been fighting and winning DUI cases. Don’t delay — let us defend your rights and protect your future.
