PAROLE VS. PROBATION
Parole and probation violations are treated similarly in the PA court system. The difference is that parole may be granted to a person convicted of a crime who has served part of their sentence in jail and probation may be granted to a person convicted of a crime in lieu of jail time.

PENALTIES FOR PROBATION VIOLATION
Whether the violation was direct or technical will determine the severity of the penalties and how the court will proceed with your case.
A direct violation means that you were charged with committing a new crime or were convicted of a new crime. A technical violation means that you did not comply with the stipulations of your probation guidelines.
CHARGED WITH A NEW CRIME WHILE ON PROBATION IN PA
Any violation or new arrest could mean that a judge can place you under a detainer and you will be unable to post bail or be released from jail until your preliminary hearing. An attorney may file a petition to have this detainer lifted, resulting in your release from jail until you await the preliminary hearing.
If the court or probation board decides to revoke your probation, you will have to serve the remainder of your probation in jail. Other consequences include your probation period being extended.

GAGNON HEARINGS FOR PROBATION VIOLATORS
Gagnon hearings are so called in reference to the Supreme Court case Gagnon v. Scarpelli, which is said to protect the due process of criminal defendants on probation.
There are two types of Gagnon hearings: Gagnon I and Gagnon II. Gagnon I is the preliminary hearing where a judge will determine if there was probable cause to believe that you violated your probation. Gagnon II is the second hearing where the court will rule whether or not your probation should be revoked.
