QUALIFICATIONS FOR THE PROBATION WITHOUT VERDICT PROGRAM
The rules and qualifications for the PWV program are highly specific and very selective. You should seek the advisement of a qualified and experienced Pittsburgh Drug Crime Attorneys to see if this program is available to you.
In order to qualify for the Probation without Verdict Program in Pennsylvania, you must:
- Not have ANY prior charges on your criminal record
- It must be your first offense
- It must be a non-violent drug charge
- Provide testimony from a doctor or psychologist who is trained in substance abuse documenting your struggle with drug addiction/abuse
- Be willing to plead “nolo contendere” or guilty to your charges
You are NOT qualified for the Probation without Verdict Program if any of the following apply to you:
- Any person who has previously been convicted of an offense under this act or similar act of the United States or any other state.
- Any person who has been convicted of a misdemeanor or felony in this Commonwealth or an equivalent crime under the laws of any other state.
- Any person who has been placed on Accelerated Rehabilitative Disposition where the person was charged with a violation of this act or the commission of a misdemeanor or felony in this Commonwealth.
- Any person who is charged with or has pleaded guilty or nolo contendere to multiple offenses which are based on separate conduct or arise from separate criminal episodes such that those offenses could be tried separately in accordance with 18 Pa.C.S. § 110 (relating to when prosecution barred by former prosecution for different offense).
- Any person who is a dangerous juvenile offender under 42 Pa.C.S. § 6302 (relating to definitions) or who was adjudicated delinquent for conduct which would constitute a violation of clause (30) or (37) of subsection (a) of section 13 of this act.
- Any person who is charged with violating clause (14), (30) or (37) of subsection (a) of section 13 of this act.
It is imperative that you are able to document and prove your dependency on drugs to the court. The purpose of the program is to help overcome addiction and keep your criminal record clean so you can move forward with your life.
You must successfully complete all of the requirements of the program. The term of probation shall be for a specific time period not to exceed the maximum for the offense upon such reasonable terms and conditions as the court may require.
Once all of the expectations have been met, you may then go back to court and petition to have the arrest and charges permanently erased from your record. However, if you fail to meet all of your obligations under the program, the court can enter a judgment against you and proceed with its typical sentencing.
