Pennsylvania Tax Fraud Lawyer
If you have been charged with tax fraud or tax evasion or are under investigation for tax fraud in Pennsylvania, you are already immersed in an extremely stressful situation that could result in harsh consequences. The penalties in Pennsylvania for a tax fraud conviction are severe and you could be sentenced to prison for years on top of being forced to pay thousands of dollars in fines.
You may be under criminal and civil investigation by both the IRS and/or the Pennsylvania Department of Revenue if you forgot to include a portion of your income or deducted a suspicious expense. Any small mistake or oversight can cause a huge headache and raise flags for the IRS.
But just because you are under investigation for a filing of your return or for the failure to file a return, does not mean that you are automatically guilty.
Even though the IRS and federal prosecutors will carefully investigate and audit every expenditure and purchase and invade your home or your office seeking documents and computer files, you are innocent until proven guilty. Many mistakes are simply human error, not intentional deceptions, and you should not have to spend time in jail or pay huge fines for a simple mistake.
If you think you are under investigation for tax fraud or tax evasion in Pennsylvania, it is imperative that you speak to an experienced and aggressive attorney right away about your situation. You need someone who will stand up for your rights to the prosecution and deliver a strong defense for your innocence, your good name and your freedom.

Facing A Tax Fraud Investigation In Pennsylvania
Anyone can be charged with tax fraud or tax evasion, including accountants and CPAs, business executives and corporate officers, small business owners and individual taxpayers. It is important to note that tax fraud or tax evasion involves intentional wrongdoing; carelessness and mistakes do not mean you committed tax fraud.
Any of the following activity could raise red flags with the IRS or PA Department of Revenue and lead to a tax fraud or tax evasion investigation:
- Not filing a tax return altogether
- Filing a false or misleading tax return
- Not reporting the full amount of income or understating income
- Inconsistent behavior
- Using tax shelters
- Concealing assets
- Failing to make estimated tax payments
- Overestimating deductions or expenses / “Creative deductions”
- Not reporting income earned internationally
- Being an accomplice in preparing a false tax return
- Not paying withholding tax / violating employer withholding requirements
- Failing to collect employment taxes
- Money laundering
- Using cash
- Not cooperating with tax authorities or making false statements to investigators

What Happens If You Are Investigated with Tax Fraud in PA?
You may be investigated by both the United States IRS and the Pennsylvania Department of Revenue. If you are suspected of individual tax fraud or business tax fraud, the tax authorities may request an interview as part of their investigation.
Our tax fraud defense attorneys can help you prepare for this interview and work to stop the investigation before criminal tax fraud charges are filed.
Tax auditors look for deliberate misconduct, not simple human error and mistakes. Even so, what they see as willful wrongdoing could easily have been a mistake or oversight. In many cases, they will seek only for you to pay the taxes you owe, plus interest and penalties, and not turn your case over to prosecutors for a full criminal investigation. However, they could still impose a civil tax fraud penalty, which is equal to 75% of the tax owed, plus interest.
If the tax auditor determines that enough evidence has been found for a criminal investigation to be prosecuted and criminal charges to be filed, your case will be transferred to the prosecution. Prosecution will then be handled by the U.S. Justice Department and/or the PA Attorney General’s office.
Having an experienced Federal Attorney and an aggressive Pennsylvania fraud attorney working on your case is critical to defending your rights and freedom.
