PENALTIES FOR DRIVING UNDER A SUSPENDED LICENSE FOR DUI

While driving under a suspended license is illegal no matter what your license has been suspended for, driving after your license has been suspended for a DUI comes with much stricter penalties, including a mandatory 60 days in jail and up to 90 days in jail as well as fines, court fees and further damage to your criminal record.

PENALTIES FOR A FIRST OFFENSE:

• Driving Under License Suspension for a DUI: Summary offense, fine of up to $500 and between 60 and 90 days in jail.

• Refusing to Submit to a BAC test: Summary offense, fine of up to $500 and between 60 and 90 days in jail.

• BAC Level of .02 or Higher: A mandatory fine of up to $1,000 and a minimum of 90 days in jail.

PENALTIES FOR A SECOND OFFENSE:

• A third degree misdemeanor, a $2,500 fine and a minimum of six months to one year in jail.

PENALTIES FOR A THIRD OFFENSE:

• A first degree misdemeanor, a $5,000 fine and a mandatory two to five years in jail.

These penalties do not include other costs such as court fees. It is also possible for your car to be impounded in certain instances.
